If you order through a third-party delivery platform or app, separate terms, fees, and refund policies of that platform will apply. Anthony's Coal Fired Pizza is not responsible for pricing discrepancies, service fees, or disputes arising from orders placed through third-party platforms.


6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANTHONY'S COAL FIRED PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • Any conduct or content of any third party on the Site;
  • Any content obtained from the Site;

IN NO EVENT SHALL ANTHONY'S COAL FIRED PIZZA'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE AND SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO ANTHONY'S COAL FIRED PIZZA IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above exclusions or limitations may not apply, and you may have additional rights.


7. Disclaimers

7.1 As-Is Basis

THE SITE AND ALL SERVICES, CONTENT, INFORMATION, AND MATERIALS PROVIDED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. ANTHONY'S COAL FIRED PIZZA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

7.2 No Warranty of Accuracy

While we make reasonable efforts to ensure that information on the Site — including menu descriptions, nutritional information, allergen disclosures, pricing, and hours of operation — is accurate and current, we do not warrant that such information is complete, accurate, reliable, or up-to-date. 7.3 Allergen Disclaimer

To the extent that any lawsuit or court proceeding is permitted under these Terms, you and Anthony's Coal Fired Pizza agree to submit to the personal and exclusive jurisdiction of the federal or state courts located within the United States and waive any objection to the laying of venue of any such proceeding in such courts. You also waive any objection that such courts are an inconvenient forum.

These Terms are also subject to applicable federal laws of the United States, including the Federal Trade Commission Act (15 U.S.C. § 45 et seq.) and, where applicable, the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), and any other applicable state consumer protection statutes.


10. Dispute Resolution

10.1 Informal Resolution

Before filing any formal legal claim, you agree to first contact Anthony's Coal Fired Pizza at [email protected] to describe the nature of your dispute and provide us with a reasonable opportunity to resolve the issue informally. Both parties agree to attempt good-faith negotiations for a period of at least thirty (30) days from the date of written notification before pursuing any formal dispute resolution mechanism.

10.2 Binding Arbitration

If informal resolution is unsuccessful, any dispute, controversy, or claim arising out of or relating to these Terms, including the formation, interpretation, breach, termination, or validity thereof, shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules then in effect, except as modified by these Terms. The arbitration shall be conducted in the English language. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

10.3 Class Action Waiver

YOU AND ANTHONY'S COAL FIRED PIZZA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

10.4 Exceptions to Arbitration

Notwithstanding the above, either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights, trade secrets, or confidential information.

10.5 Arbitration Fees

The allocation of arbitration fees and costs shall be governed by the applicable AAA Consumer Arbitration Rules. If you are an individual consumer and your claim is for less than $10,000 USD, Anthony's Coal Fired Pizza will pay all arbitration filing fees and AAA administrative fees unless the arbitrator finds your claim to be frivolous or brought in bad faith.


11. Term and Termination

11.1 Term

These Terms of Service shall remain in full force and effect for as long as you access or use the Site or our services, or maintain an account with us, unless earlier terminated in accordance with the provisions herein.

11.2 Termination by You

You may terminate your use of the Site and your account at any time by ceasing to use the Site and, if applicable, by submitting a request to delete your account at [email protected]. Termination of your account will not relieve you of any obligations incurred prior to termination, including payment for any orders submitted prior to the termination date.

11.3 Termination by Us
